Justin I. King is a partner of the firm, a former U.S. Patent Examiner at the U.S. Patent & Trademark Office (USPTO), registered patent attorney , a member of the Maryland Bar, and is registered to practice before the United States Court of Federal Appeals for the Federal Circuit (CAFC). Mr. King's areas of expertise includes prosecution before the USPTO, litigation counseling, and opinions regarding infringement dispute, particularly in evaluating the patent invalidity and the scope of claimed limitations.
Prior to WPAT, P.C., Mr. King examined patents at the USPTO Technology Group 2100 (computer software, hardware and information security) for nearly five years. Mr. King has examined hundreds of applications relating to bus protocol, interrupt, and I/O control. Mr. King has received numerous favorable decisions from the Board of Patent Appeal and Interference. Mr. King also has extensive hands-on experience in computer technologies. Prior to the USPTO, Mr. King was a senior engineer for implementing computer infrastructure and integrating computer systems in the private sector for eight years. Mr. King had designed and implemented various communication systems for AT&T, MCI, U.S. Navy, and North Atlantic Treaty Organization. In addition, Mr. King also has chaired an e-commerce project to support on-line secured commercial transactions.
In handling pending applications in front of the USPTO, Mr. King provides counseling to clients on issues regarding both prosecution procedures and the underlying substantive technologies. With WPAT's Northern Virginia office conveniently located miles from the USPTO, Mr. King has direct access to USPTO to conduct in-person conference meetings with patent examiners on behalf of his clients. Mr. King's prior USPTO experience and his industry experience have proved to be tremendously invaluable in these in-person conference meetings with Patent Examiners. Information obtained from these in-person conference meetings enables his clients in identifying and verifying obstacles in pending applications, thus expediting prosecution.
To resolve any alleged patent infringement, Mr. King provides patent invalidity and claim scope analysis. He analyzes the patent in dispute regarding potential validity issues and determines the scope of the claimed limitation base on prosecution history. The result of such analysis enables his clients in determining the next best course of the actions in line with their business objective with minimum economical impact on their daily operations. Mr. King's patent invalidity and claim scope analysis also assist clients to determine the strength of their existing patents and possibly to enforce their intellectual property interest by licensing agreement or litigation.
In addition to patent prosecution practice and patent infringement analysis, Mr. King also provides counseling on securing intellectual property interest with strategic planning, including patent cycle development, freedom-to-operate opinions, and patent portfolio building. Mr. King assists his clients to structure intellectual property protection as an integrated part of R&D. With on-going continuous R&D cycles, companies are counseled to strategically build a patent portfolio to increase market exposure, and to secure commercial interest.
Mr. King received his Juris Doctor degree from the Columbia School of Law, the Catholic University of America, and his Bachelor of Science degree in Computer Science at University of Maryland, College Park. Mr. King also has studied in the MBA program at George Washington University. Mr. King lectured as a guest speaker at Chung Yuan Christian University, at its 2007 Patent Seminar, on the latest U.S. Supreme Court rulings.
